Terms and Conditions for Chimney Doctor Transactional SMS System

These terms and conditions govern your use of Chimney Doctor's transactional SMS system. By using our SMS system, you agree to comply with and be bound by these terms. If you do not agree with any part of these terms, please do not use our SMS system.

1. Use of SMS System

You agree to use our transactional SMS system only for lawful purposes and in accordance with these terms and any applicable laws and regulations.
You may not use our SMS system to transmit any unlawful, defamatory, obscene, or otherwise objectionable content.

2. Message Content

You acknowledge and agree that the content of messages sent through our SMS system is the sole responsibility of the sender.
We reserve the right to review and monitor message content to ensure compliance with these terms and applicable laws.

3. User Conduct

You agree not to engage in any activity that may interfere with or disrupt the operation of our SMS system or the networks through which it is accessed.
You may not attempt to gain unauthorized access to our SMS system or any related systems or networks.

4. Privacy

Your use of our transactional SMS system is subject to our Privacy Policy, which outlines how we collect, use, and disclose your information. By using our SMS system, you consent to the collection and use of your information as described in the Privacy Policy.

5. Intellectual Property

All intellectual property rights in our transactional SMS system, including but not limited to trademarks, logos, and software, are owned by or licensed to Chimney Doctor. You may not use, reproduce, or distribute any of our intellectual property without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our transactional SMS system.
In no event shall our total liability to you exceed the amount paid by you, if any, for using our SMS system.

7. Indemnification

You agree to indemnify and hold Chimney Doctor, its affiliates, officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way related to your use of our SMS system or violation of these terms.

8. Modifications

We reserve the right to modify or terminate our transactional SMS system or these terms at any time without prior notice. Any changes to these terms will be effective immediately upon posting on our website.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California without regard to its conflict of law principles.

We have been using the Chimney Doctor for several seasons now to care for our fireplace and we cannot imagine using any other company. The staff is always prompt, kind, swift and thorough. Every year we get a scheduling call at least a month in advance to secure a spot in their very busy calendar and a reminder text a few days out. Additionally, a text gives us a heads up when the tech is headed our way. These folks are honest and the pricing fair and clear. It feels great to be able to support a local, "mom and pop" company that is centered right here in our community. If you use your fireplace every year to heat your living room/bedroom/ etc. do yourself a favor and get the Chimney doctor out to care for it, yearly.

Chimney, doctor was very flexible with my property. I had human relations issues and they were very helpful in rescheduling three times. They were cheerful when helping me with my personality issues We finally got them in there and they thoroughly inspected my equipment. I have two Fireplace inserts and they always ensure that there’s no intrusion of water on these exhaust on the roof. I couldn’t be happier with this company if you have a fireplace fireplace insert or a chimney that needs to be swept. Chimney, doctor is on-call.
